Terms of Service

1. Scope and provider

Lark Goals is a service provided by SW labs – Felix Winkel("we", "us"). Our full company details and postal address are set out in our legal notice. These Terms govern your use of Lark Goals.

2. The service

Lark Goals lets you (the "Committer") commit to a recurring habit and back that commitment with a monetary stake, set per challenge at setup. For each scheduled check-in, you report whether you completed the habit, and an independent person you designate (the "Approver") verifies that report — the Approver never verifies their own check-ins, and you may not act as your own Approver. If a check-in is confirmed missed, either by the Approver's verdict or by an unanswered deadline resolving to a default, the stake for that check-in is charged. If a check-in is confirmed completed, nothing is charged for it.

Whether German law grants you a statutory 14-day right of withdrawal (§ 312g BGB) from this arrangement, and — if the right does not apply because the service is confirmed as fully performed check-in by check-in — the precise consent clause required under § 356 (4) BGB, is currently under legal review. This paragraph will be replaced with the reviewed wording once that review is complete.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into this agreement to use Lark Goals.

4. Your account

Your account is tied to your Telegram identity. You are responsible for keeping your Telegram account secure. You may not act as your own Approver.

5. Payments and cancellation

Your payment method is stored via Stripe when you set up a challenge; no funds are held or reserved in advance and no interest accrues on staked amounts. A charge is only created once a check-in is confirmed missed — check-ins you complete are never charged. See Section 2 for the currently unresolved question of whether, and on what terms, you may withdraw from this agreement within the statutory withdrawal period.

6. Not an investment, savings, or gambling product

Lark Goals is not an investment product, savings product, or gambling product. Staked amounts are not held on your behalf, do not accrue interest, and are not returned to you under any circumstances once forfeited.

7. Limitation of liability

We are liable without limitation for intent and gross negligence. For ordinary negligence, we are liable only for the breach of a material contractual obligation — a duty whose fulfilment is essential to the proper performance of this agreement and on which you may reasonably rely — and in that case, liability is limited to the damage typically foreseeable at the time the contract was formed. This limitation does not apply to injury to life, body, or health, or to any liability that cannot be excluded or limited under mandatory law (e.g. the German Product Liability Act).

8. Changes to these Terms

We may update these Terms from time to time. Continued use of Lark Goals after a change constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.
